Employee and Crew GPS Tracking & Location Monitoring Policy

Notice to Business Owners: This document is a template for informational purposes. Employment law, including rules governing workplace monitoring and GPS tracking, varies significantly by state. Before implementing GPS tracking of employees, consult a licensed employment attorney in your jurisdiction. Some states require written consent; others require notice but not consent; others have specific rules for tracking during non-work hours. This template does not constitute legal advice.
1. Purpose and Scope
This policy describes how [Company Name] ("the Company") uses GPS location tracking through EstimatorPRO software as part of its workforce management practices. This policy applies to all employees, temporary workers, and crew members who use company-provided or personal devices to clock in and out through EstimatorPRO while performing work for the Company.
2. What Is Tracked
When a crew member clocks in through EstimatorPRO, the following data is recorded:
- Clock-in location: GPS coordinates at the moment of clock-in, creating a time-stamped record of where the crew member started their shift
- Real-time position (Crew Plan only): GPS position updated approximately every 30 seconds while the crew member is clocked in, visible to supervisors and company administrators through the Live Crew Map
- Clock-out location: GPS coordinates at the moment of clock-out
Location tracking is active only during clock-in periods. The app does not collect location data before a crew member clocks in or after they clock out.
3. Why We Track Location
The Company uses GPS tracking for the following legitimate business purposes:
- Verifying crew arrival at job sites
- Coordinating crews across multiple simultaneous job sites
- Ensuring crew safety by knowing where field workers are located
- Accurate time and attendance records linked to specific job locations
- Dispute resolution regarding hours worked or job site presence
- Insurance and liability documentation
4. Who Can See Location Data
GPS location data collected through EstimatorPRO is visible to:
- The company owner and any administrator accounts on the EstimatorPRO license
- EstimatorPRO (pascat graphics and marketing company) as the platform operator, subject to its Privacy Policy
Location data is not sold or shared with third parties, advertisers, or other crew members.
5. Personal Devices (BYOD)
If you are clocking in and out using your personal phone or tablet, GPS tracking is limited to the clock-in and clock-out events and, on the Crew plan, continuous updates while clocked in. The app does not access any other data on your personal device — no contacts, no messages, no photos, no apps. Refer to the separate BYOD Policy for full details.
6. Off-Hours Tracking
The Company does not track employee location outside of active clock-in periods. If you believe you are being tracked when not clocked in, contact [Company Owner Name] immediately at [phone number].
7. State-Specific Notice Requirements
Depending on your state of employment, additional legal requirements may apply:
- California: Labor Code § 980 prohibits employers from requiring employees to install tracking applications on personal devices without consent. Employees have stronger privacy protections during non-work hours. Written consent is strongly recommended.
- New York: Civil Rights Law § 52-c requires employers to notify employees in writing before monitoring electronic devices. Written acknowledgment is required.
- Connecticut, Delaware, and other states: Have specific electronic monitoring notice requirements. Check your state's current requirements.
- All other states: Tracking on company-owned devices during work hours is generally permissible with notice. Tracking on personal devices typically requires consent.

8. Acknowledgment and Consent
By continuing to use EstimatorPRO to clock in and out, crew members acknowledge that they have received notice of this GPS tracking policy. Where written consent is required by law, a separate signed acknowledgment form should be used.

I understand that location tracking is limited to clock-in periods and does not occur when I am not actively clocked in.
