By accessing or using EstimatorPRO ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by pascat graphics and marketing company ("we," "us," or "our").
EstimatorPRO is a software-as-a-service platform designed for tree service companies. Features include estimating, invoicing, scheduling, time tracking, GPS mapping, customer management, document generation, payment processing integration, and related tools. Specific features vary by subscription plan.
Access to the Service requires a license code issued by us after you complete the trial signup process. You are responsible for maintaining the confidentiality of your license code and for all activity that occurs under your account. You must notify us immediately at support@estimatorpro.co if you believe your account has been compromised.
After the 14-day free trial period, continued access requires a paid subscription. Subscriptions are billed monthly or annually depending on the plan selected. All fees are in US dollars. We reserve the right to change pricing with 30 days notice. Failure to pay may result in suspension or termination of your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You may not use the Service to store or transmit illegal content, to engage in fraud, or to interfere with the operation of the Service or other users.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you input into the Service. We do not sell your data to third parties.
The Service integrates with third-party services including Stripe (payment processing), Twilio (SMS), QuickBooks (accounting), and Google (Maps, Calendar). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
The Service, including its software, design, and content, is owned by pascat graphics and marketing company and protected by applicable intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works based on the Service.
The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Your use of the Service is at your sole risk.
To the maximum extent permitted by law, pascat graphics and marketing company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
You may cancel your subscription at any time. We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to access the Service ceases. Data may be retained for up to 90 days after termination before permanent deletion.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Virginia.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
